Standard Operating Procedures On Mediation

 

    Pre-Mediation:

    • Fill in the agreement to mediate form (Form 1) which can be found from the Sarawak CMS or the Sub Registry Counter. Then, submit the said form through CMS system
    • The mediation centre will: -

               (i) register the said mediation in the CMS; and

               (ii) inform the officers selected as mediator through their interpreters.

    •  Parties need to submit the summary of the case within two weeks after mediation was registered. The date of the mediation session will be fixed.

     

    During Mediation:

    • All parties are required to be present at the mediation centre 15 minutes before the scheduled mediation session.
    • All parties are encouraged to send only one representative to attend the mediation session.
    • All attending representatives must have the mandate to make decisions.

     

    Post-Mediation:

    • Where a case was successfully resolved, Lawyer must prepare a draft order, duly agreed upon and signed by the parties involved, before informing the Court to for the purposes of recording the Consent Order.
    • A copy of the draft order must be sent to the Mediation Center as notice.
    • Cases which fail to be resolved will be sent back to the Judge or the Court for trial.
